Law should get tough on sex with minors
In Costa Rica, having sex with a minor is not
always punished. The law turns a blind eye to a problem
that the government and several child advocate agencies
have been telling us for years
The new laws passed in the last 2 years, clearly makes it
an offence and aims
to punish anyone who engages in sexual acts with a minor,
younger than 18, and included parents or guardians who
knowingly allow it go on.
There have been several reports of a parent being charged
and later convicted of prostituting their young daughters.
And the latest case of an American now in preventive jail
who is being investigated for child pornography and
pimping minors.
But this law is not always applied as it should.
Take the case reported this past week about a pregnant 9
year old Nicaraguan (see story
of Feb. 5th ), presumed to have been raped by a 20 year old
man. The parents are asking that the young man, to not be
jailed but rather that he take responsibility for the
child.
Come on now. This is a clear act of having committing a
sexual act with a minor. The law is more concerned about
investigating a case of rape and not putting behind the
man behind bars on the more serious charge.
In Costa Rica, having sex with a minor is punishable up to
8 years in prison and there is no time off for good
behaviour. The law is strong in that is assumes – not
presumes – guilt and punishment is forthcoming unless
there is strong evidence to the contrary.
What the law needs is strong enforcement.
