Address To Be Accurate
And Current
A new law, the Ley de
Notificaciones
Judiciales (Law of
Judicial Notices)
obligates every person
to update his or her
address in the Registro
Civil (Civil Registry)
and communicate any
changes. The aim of the
measure is to avoid
deliberate actions of
those who seek to evade
notices of a "demanda"
(judicial action).
The change is partly due
to new regulations
regarding civil suits
that now take months,
instead of years, to
settle and if the
address information is
not correct, claims can
be dismissed for
non-service, which
promoters of the
legislation estimate
that 30% will continue
with erroneous
information.
The new law approved by
the Comisión Plena II
will go into effect one
month after it is
published in the
official government
publication, La Gaceta,
at which time every
citizen has one year to
update his or her home
address information.
Failing to update the
information can lead to
a judicial action
against the individual
which includes
appointing a nominee to
stand in during the
process. In this way, an
individual cannot escape
the claim by simply not
providing a correct
address.
The law also allows
notifications to be
given by fax and email
and certified mail. In
places, like
condominiums or farms or
residences where
judicial processors
cannot obtain access,
the law allows for
notice to be delivered
to the person in charge,
like a guard at the
condominium gate.
The law eases the
current system of
serving notices since
there are no
"traditional" addresses
in Costa Rica, as
addresses are mostly by
reference point,
direction, colour of the
gate, fence or
structure.
A typical address in San
José reads like this:
"Plaza Mayor, 100 metros
Norte, 50 Metros Oeste,
Casa de dos pisos, con
porton negro y reja
blanca".
