Caja Cannot Test Job
Applicants For HIV
The Sala Constitucional (Constitutional
Court) has ruled that the Caja Costarricense
de Seguro Social (CCSS) - Social Security -
cannot demand an HIV test as part of its job
application.
The court decision follows an appeal by a
man who worked at the Centro Nacional de
Rehabilitación (Cenare).
The court orders Vinicio Mesén Madrigal,
head of the Cenare, to stop the practice of
AIDS testing of job applicants at the
medical centre. The court ruling applies
also to "voluntary" workers at the centre.
In the court filing, the man, whose identity
was protected, said he was required to take
a series of medical exams, including an HIV
test, as part of a promotion at the medical
centre.
The other tests included x-rays of his
spine, test for hepatitis and syphilis.
The court ruled that the requirement is
unconstitutional and also ordered the CCSS
to pay costs and damages. |
