Constitutional
Court Gives
Green Light To
Referendum On
Same Sex
Marriages
The Sala
Constitucional
(Constitutional
Court) flatly
rejected the two
appeal by
organizations
against the
proposed
referendum on
same sex
marriages. The
Sala's decision
gives the green
light for the
referendum that
will be included
in the December
municipal
elections.
The first of the
two court
actions was
filed by Yashin
Castrillo and
the second by
the Defensora de
los Habitantes
(Ombudsman),
Ofelia
Taitelbaum,
claiming the
referendum would
be a violation
of human rights.
The call for a
referendum was
made by several
civil society
groups,
including the
Observatorio
Ciudadano,
seeking persons
of the same sex
to have the same
rights of a
heterosexual
marriage and to
legalize same
sex marriages.
