An Appeal in this instance should be based on an error in law only, not an error in fact. The accused is facing double jeopardy, which should be a bar to a second trial in this instance.

Also, it is probably a big waste of time and resources going back to court on this one, without having even established a possible motive, and wthout hard evidence or witnesses.
