Injunction
Extended at
Crucitas Open
Pit Mining
On Friday, April
16, 2010, Costa
Rica's
Constitutional
Court or "SALA
IV" ruled that
the challenges
to the grant of
permits allowing
development of
the Company's
Crucitas gold
project were
without merit,
ending the
suspension of
development
activity at the
project.
Immediately, on
Saturday 17,
an opposition
group to open
pit mining
Crucitas filed
and injunction
with the
Tribunal
Contencioso
Administrativo,
which suspended
work on the
project for
three business
days.
On Wednesday,
April 21,
Infinito Gold
Ltd., submitted
written material
to the Tribunal
argueing that
the injunction
should be
removed, based,
in part, upon
the legal
principle of
Cosa Juzgada
which states
that no lower
court will rule
again on the
same matters
that have been
addressed by the
SALA IV.
However, on
Friday, April
23, the Tribunal
issued notice
that it has
extended the
injunction,
which will
continued until
April 28, 2010.
Although
Infinito plans
to appeal the
Tribunal's
extension, it
may be a losing
battle given
that
president-elect,
Laura
Chinchilla, said
last week that
one of her first
acts of
president is
issue a decree
for a moratorium
on open pit
mining in Costa
Rica.
