Killer Driver Avoids Trial and Possible Jail

A deal with the Christopher Lang family will keep the drunk driver who killed the cyclist on March 14, 2010, from going to trial and jail.

The driver, only identified by his last name, Rivera, met with the wife and father of the victim, Jamie Lizano and Mario Antonio Lang, and lawyers, last Friday at the Juzgado Penal de La Unión de Cartago, whereby an agreement was compensation agreement was reached.

The details of the deal are being kept private due to a non-disclosure clause.

Rivera now has 60 days to comply with the terms of the deal which will be up to judge Mario Piedra to determine if and when the completion took place. Once Rivera completes his terms of the deal the judge will then cancel the charges and trial process for manslaughter.

Karen Bermúdez, the prosecutor of the Unión district did not approve the deal, saying that there is sufficient evidence to hold a trial and convict the driver who was driving drunk at the time of the accident and without the participation of the family.

Bermúdez stressed the seriousness of the case and that alcohol and speeding was involved in the accident.

Notwithstanding the deal made with the family of the victims, the Ministerio Público, as is the case until all the parties are satisfied, keeps the case open.

Lang was struck by Rivera with his vehicle while taking a rest break while cycling  on the  Florencio Castillo, autopista to Cartago, near the Pasoca mall, early Sunday morning of March 14.

Rivera, was found with a 0.93 blood alcohol content, when the accident occurred shortly after 7am.
